I think Gary's issues were the skis de-cambered.
I bought them very slightly used in a private transaction without warranty. I accepted the risk, and enjoyed the very deep discount. It would not be ethical to ask Head for warranty help.
I applaud your sense of ethics. That's the way it should be.
However, another guideline is also to try and swap positions with the other person and then see what seems reasonable. If I were Head, I think I would want a satisfied customer. At least I would want the customer to call, be honest about the situation as you were above, and then let me decide whether any of Head's warranty policies might apply. I might even respond positively to your comments about "these wonderful skis that are no longer sold". You don't have to "expect" them to do anything, but at the same time it sounds as if you don't believe that this is "normal wear and tear on the ski" either?
I'm reminded of the many times (truer in the past) that car manufacturers were aware of a common problem that wasn't documented anywhere except in service manuals. In the 24" snowstorm a couple of years back, an attachment broke off the top of the carbon fuel vapor cannister. I was willing to accept the blame because I was driving through very deep snow and didn't assume my Rav4 was made for Jeep conditions. In fact, I was quite impressed that my RAV4 could even get to the plowed streets. I was quite surprised to find out that this was a known and common problem on V6 RAV4's and they fixed it under "warranty".
I could get you the number of Winn who owns Idylwood ski shop near Elk Mountain if you want. I don't know they could do the work themselves, but he is a Head dealer and seems a straight shooter. Lynn bought a pair of EveryThangs (used) from Harb Ski Systems and the heel piece pulled out of the ski the next year. She went to Winn to get it redrilled, he suggested taking it to the Head rep first. He gave them the whole story including the purchase history, they replaced her skis with a pair of new, but prior year models. She was intending to just get the ski redrilled. He was the one that suggested letting him take it to Head, that this shouldn't have happened, and that Head really stands behind their products.
